By using this website you acknowledge any transaction is subject to our terms and conditions. We reserve the right to change these terms and conditions at any time. It is your responsibility to read the terms and conditions.
We assure any goods purchased through our website will be of satisfactory quality. Upon receipt of goods, they buyer shall take reasonable steps to inspect the same as soon as possible and shall forthwith give notice to the seller of any defects. We shall endeavour to ensure the description and specification of our goods are correct at the time of publication. However, specification and description of goods on this website are not intended to be binding and are intended only to give a general description of the goods. While colour reproduction is close, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. All goods are sold on the basis for domestic use only.
Our liability is strictly limited to the value of the goods.
All orders placed on this website will be subject to acceptance in accordance with the terms and conditions. Acceptance of your order, will take place on despatch of the goods unless we have notified you that we do not accept your order or you have cancelled it.
When you place your order on our website, please allow 28 days for delivery. We shall ensure every effort is made to deliver the goods within the estimated timescale. However delays are occasionally inevitable due to unforeseen factors. We shall be under no liability for any delay or failure to deliver the goods if caused directly or indirectly by circumstances beyond our reasonable control. If the goods are not delivered within one week from date of despatch the customer should advise us. We will make every effort to locate the goods and if necessary send a replacement at our expense or provide a full refund. All goods will be shipped by a carrier and must be signed for on receipt. If goods arrive damaged, the customer must inform us within 3 working days of receipt and return the goods within 7 working days from receipt. We will send replacement upon confirmation the damaged goods have been returned. Risk of loss or damage are passed onto the customer on receipt.
Force Majeure – neither the seller nor the buyer shall be liable to the other or to be deemed to be in breach of contract, by reason of any delay in performing or failure to preform any of its obligations in relation to goods if the delay or failure was beyond that party’s reasonable control. Without prejudice to the generality of the foregoing the following shall be regarded as a force majeure. Act of god, explosion, flood, tempest, fire or accident, war of threat of war, sabotage, insurrection, civil disturbance or requisition: acts, restrictions, regulations, bye-laws, prohibitions or matters of any kind on the part of any supra-national, governmental, parliamentary or local authority, import or export regulations or embargos, strikes, lock-outs or other industrial actions or trade disputes (whether involving employees of the seller or any third party): difficulties in obtaining, raw materials, labour, fuel, parts of machinery, or power failure or breakdown in machinery.
Prices are liable to change at any time but will not affect confirmed orders. Payment can be made by the methods detailed in our payment & prices section. All credit card/debit card payments are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses, or subsequently refuses, to or does not for any reason authorise payment to us, we will not be liable for any delay or non delivery.
Rights – orders may be cancelled at any point prior to despatch by notification by email to email@example.com or in writing to A W Hainsworth & Sons Ltd, Spring Valley Mills, Stanningley, Leeds, LS28 6DW. If you cancel within the cancellation period, your card payment will be refunded within 30 days. If you are not entirely satisfied with your order, you may cancel within 7 working days from receipt and an exchange or refund will be offered providing the goods are returned complete, in original condition and in their original packaging. We will honour the value of the returned item. We recommend you maintain proof of postage when returning the goods as we cannot accept responsibility for goods lost in transit. For all returns except where faulty or damaged, you will be required to arrange and pay for the return. When returning the goods, please state clearly whether you would like exchange or refund. Please take care to read the care labels as we cannot refund or exchange goods that have been damaged when cleaning, ironing or in the wash.
Waiver - No failure or delay by a party to exercise any right or remedy provided under these terms and conditions or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
Severability - If any provision of these terms and conditions, or part of any provision, is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this agreement, and the validity and enforceability of the other provisions of this agreement shall not be affected. If a provision of these terms and conditions, or part of any provision, is found illegal, invalid or unenforceable, we shall inform you and amend such provision such that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the original commercial intention.
Entire agreement - These terms and conditions constitute the whole agreement between us and supersede all previous agreements between the parties relating to its subject matter. You acknowledge that, in entering into a contract for the purchase of goods, you have not relied on, and shall have no right or remedy in respect of, any statement, representation, assurance or warranty, whether made negligently or innocently, other than as expressly set out in these terms and conditions.
Nothing in this clause shall limit or exclude any liability for fraud.
Governing law and jurisdiction - Contracts for the purchase of goods through our website will be governed by English law. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site or from any contract for the purchase of the goods although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms and conditions are governed by English law.
